A pregnant woman who was admitted to a hospital emergency room with symptoms of distress including shortness of breath, nausea and vomiting was forced to wait for medical attention for more than 2 hours. Additionally, she was told to walk on her own to the labor and delivery unit despite her advanced pregnancy and the potential danger such movement would cause her. The hospital failed to provide emergency medical assessment, stabilization and care, as defined by EMTALA, leading to serious injury for the mother and permanent debilitating effects on her infant son. Michels & Lew obtained a favorable settlement on behalf of the woman, her son and her husband.
